Terms & Conditions Chartering of Aircraft and Helicopter

Please note that the following details are the basic requirements for chartering of aircraft and helicopter:

Mentioned flight timings & cost are representations under NIL wind conditions, and billing will be based on the actual time taken for the flight — “Engine on to Engine Off.” Flight duration and cost may vary depending on weather, wind, fog, visibility, and other environmental factors. All flight schedules are subject to change, delay, or diversion due to weather conditions, flight safety concerns, or operational restrictions.

  • Watch Hours Extension: Charges payable to the Authorities for operations to/from airfields will be borne by the charterer.
  • Boarding/Lodging & Transportation: Pilot and AME to be accommodated in Five Star Hotels/VVIP Hostels; Technician and Ops staff in three-star accommodation.
  • Helicopter Maintenance: Maintained as per rules. Major maintenance may require relocation to Mumbai (Juhu) or original base.
  • Fuel Transportation: Fuel positioning costs from origin to origin are to be covered by the client.
  • Helipad Preparation: Temporary helipads must comply with DGCA guidelines; safety at the site is the client’s responsibility.
  • Baggage Rules: 1 bag per passenger — up to 5 kg (helicopter) and 25 kg (aircraft). No baggage allowed in the passenger cabin.
  • Landing Permissions & Coordinates: Client must obtain permissions from authorities for public landings and from property owners for private landings.
  • Helipad Security: Client must ensure all helipads are secured. No routine IFR/Night flying. All landings must be before sunset; captain's decision is final.
  • Flying Program: Flying program must be received in advance to ensure proper arrangements and execution.
  • Refueling Facility: Clients must ensure flying programs are submitted at least 24 hours in advance.
  • Flying Regulations: All flights to follow DGCA and FDTL rules as applicable.
  • Privacy: Email addresses and information collected are for essential service updates and communication only.
  • Intellectual Property: All materials are protected. No reproduction or distribution without Aurea Aviation’s written permission.
  • Confidentiality: Users must respect the privacy and confidentiality of shared information.
  • Restricted Use: Services must not be used for any unlawful or unauthorized activities causing harm to Aurea Aviation or users.

Terms & Conditions of Charter

For confirmation, we require 100% advance payment based on the indicated flying time, overnight stay, waiting charges, etc. The payment should be made via Cheque or Draft in favour of Aurea Aviation Pvt. Ltd., payable at Mumbai.

  • FORCE MAJEURE: Operator does not hold itself responsible for non-operation of charter for any unforeseen reason/s such as:
    1. Bad Weather
    2. Poor Visibility
    3. Non-Availability of clearances from ATC / Defence Authorities / Civil Administration
    4. Technical Problem
  • Flight Cancellation: Due to the above reasons, if the flight cannot take off from the originating station, the amount will be refunded as per the cancellation clause.
  • Weather En-route or at Destination: We always obtain the destination weather before departure. However, if due to sudden deterioration of weather en-route/destination the aircraft cannot land and has to return or divert, the actual flying time would be chargeable and the balance, if any, would be payable/refundable.
  • Technical Snags: Operator is not responsible if any technical snag develops in the aircraft which cannot be rectified within the time limit and affects the operation of the flight.
  • Watch Hours Extension: Extension of watch hours charges will be billed on actuals. A copy of the bill from the Airport Authority of India will be forwarded to the client.
  • Bank Charges: A 3.5% payment deduction fee will be applicable on payments made to Aurea Aviation's account. By making a payment, you agree to comply with and be bound by these terms. Please read them carefully and seek clarification if needed.
  • Minimum Flying Time: A minimum of 2 hours flying time will be charged on a daily basis. The flying time quoted is approximate and may vary. Final settlement of bills will be based on actual hours flown, over and above the estimated flying time, from our base at Mumbai and back to base.
  • Flight Timings & Billing: Flight timings are indicated under NIL wind conditions. Billing will be based on actual time taken for the flight—from “chokes off” to “chokes on,” depending on weather, wind, fog, visibility conditions. Flight schedules are subject to change or diversion due to weather, flight safety, and operational restrictions.
  • Payments: 25% of the charter estimated cost shall be payable in advance at the time of blocking the aircraft. The balance of the estimated cost shall be payable 3 days prior to the flight confirmation. The actual cost shall be payable within 7 days of actual billing. If the flight is confirmed less than 3 days before the flying date, 100% of the estimated cost shall be payable upfront.

  • Cancellation Charges:
    (a) An amount of Rs.10,000 against flight preparation charges will be levied if flight is cancelled due to “force majeure” reasons.
    (b) 25% of the total estimated charter cost will be levied if the flight is cancelled after confirmation.
    (c) 50% of the total estimated charter cost will be levied if the flight is cancelled within 48 to 24 hrs. of the scheduled departure.
    (d) 100% of the total estimated charter cost will be levied if the flight is cancelled within 24 hrs. of scheduled departure or in case of “no show.”
  • All costs are estimated based on distance and approximate cruising speed of the aircraft in nil wind conditions. Any delay/diversion due to bad weather, refuelling, VVIP/VIP flight, unserviceable runway, etc. are not considered.
  • We look forward to your confirmation of the above charter and assure you of our best services at all times.
  • We require names, nationality, passport number, date of issue, and expiry of passports of passengers traveling well in advance to obtain prior permissions in case of foreign passengers.
